The case had been set for trial Friday before Magistrate Judge James Phelan. But assistant district attorney Jacqie Spradling asked that it be dismissed because it was the second time that Kimberly Dalton of Boca Raton, Fla., failed to appear.

Dalton, 31, was accused of grabbing his wife’s hair and pulling her down early on Nov. 25 when she visited him for Thanksgiving.
